The Florida Legislature passed a law addressing the issue of annuity fraud and strengthening penalties against Agents who use predatory sales practices. Since its passage, the statute has been revised and updated several times. The purpose of this law is to “set forth standards and procedures for making recommendations to senior consumers which result in a transaction involving annuity products to appropriately address the insurance needs and financial objectives of senior consumers at the time of the transaction”. The statute is based on the National Association of Insurance Commissioners (NAIC) Senior Protection in Annuity Transactions Model Regulations, which has been adopted in some form in many other states.
